The Health Care Repeal Lawsuit Moves Forward Thursday. Let’s Stop It!

We’re outraged that Texas leaders are spearheading the Health Care Repeal Lawsuit to end protections for pre-existing health conditions and other benefits provided by the Affordable Care Act (ACA). We’re concerned that this week they are taking one more big step in that direction. And we’re asking you to take action with us this week to help stop the lawsuit.

This Thursday, Texas Attorney General Ken Paxton will join with the Trump administration and leaders of 17 other states as they will file their opening briefs with the U.S. Supreme Court. A decision is expected in 2021.

Their disturbing attack on our health care could eliminate:

  1. protections for pre-existing conditions,

  2. limits on how much insurance companies can charge older Americans,

  3. the ability of young people under age 26 to stay on their parents’ insurance,

  4. subsidies that millions of Americans have used to buy reduced-price insurance on healthcare.gov,

  5. requirements for insurance companies to cover immunizations, mental health, and other Essential Health Benefits,

  6. Medicaid expansion funding that 36 states use to offer health coverage to low-wage workers,

  7. and other protections under the Affordable Care Act (ACA).

When you add it all up, the Health Care Repeal Lawsuit would eliminate insurance for an estimated 20 million Americans and 1.7 million Texans.

This would be awful under any circumstances, but it’s particularly appalling as Texas families are dealing with a global pandemic and an economic meltdown that already eliminated job-based health insurance for 1.6 million Texans.

Fortunately, many Texans — from doctors to editorial boards to everyday Texans — are speaking out against the Health Care Repeal Lawsuit.

Together, we’re urging state leaders to cancel the lawsuit, focus on reducing the state’s sky-high uninsured rate, and make health coverage part of the state’s strategy for combating the pandemic and the recession.
