Health Care Repeal Lawsuit Moves Forward on Eve of Anniversary

Did you hear the big news about the fate of protections for pre-existing conditions and other health benefits?

The U.S. Supreme Court announced that this fall it will take up the Health Care Repeal Lawsuit that Texas leaders and the White House are pushing. A decision is expected in 2021.

We are furious that our state leaders are spearheading this lawsuit — and we need your help fighting back.

Their attack on our health care could eliminate:

  • protections for pre-existing conditions,

  • limits on how much insurance companies can charge older Americans,

  • the ability of young people under age 26 to stay on their parents’ insurance,

  • subsidies that millions of Americans have used to buy reduced-price insurance on healthcare.gov,

  • requirements for insurance companies to cover immunizations, mental health, and other Essential Health Benefits,

  • Medicaid expansion funding that 36 states use to offer health coverage to low-wage workers,

  • and other protections under the Affordable Care Act (ACA).

All told, the Health Care Repeal Lawsuit would eliminate insurance for an estimated 20 million Americans and 1.7 million Texans.

With the 10-year anniversary of the ACA coming up on March 23, we should be celebrating all the progress we've madeThe health care law is more popular than ever. As the ACA was implemented, the uninsured rate improved year after year in Texas, going from 22.1 percent in 2013 to 16.6 percent in 2016, before starting to get worse again over the last two years. Of course, the state's uninsured rate would have fallen much further if Texas leaders implemented Medicaid expansion.

Now, instead of celebrating our progress under the ACA and trying to build on it, we need to focus on defending it.

So, here's what you can do:

  1. Call on Texas Attorney General Ken Paxton to stop his Health Care Repeal Lawsuit! State leaders should focus on reducing our state's worst-in-the-nation uninsured rate instead of attacking our health care.
